COLUMBUS (WCMH) — A man has been indicted for a 1997 rape and home invasion, despite investigators not yet knowing who he is.
The Franklin County grand jury has indicted a man known as John Doe WH 8/2/97 on charges of aggravated burglary, aggravated robbery, kidnapping and rape.
On August 2, 1997, a 41-year-old woman was awakened by a man pointing a gun at her head.
Franklin County Prosecuting Attorney Ron O’Brien says the man then proceeded to rob and rape her.
A sexual assault exam kit was preserved for later testing. Due to advances in scientific testing, that kit was submitted to BCI for testing in May of 2015.
A DNA profile was obtained, but there was no match to a known suspect.
“In order to preserve our ability to prosecute this case due to a 25-year statute of limitations, we are indicting that DNA profile now. When the rapist is identified the indictment will be amended to reflect his true name,” O’Brien said.
O’Brien said that courts have upheld the use of John Doe indictments in the past to help in the prosecution of criminal who might otherwise avoid escape justice.
