"The "Save the Dream" website at www.savethedream.ohio.gov provides the following questions to ask yourself to determine if you are a victim of predatory lending:
- Does your past credit history justify the high rate and fees charged?
- Is the loan being made on the basis of your ability to repay the loan and not solely on the value of the property?
- Have the loan's terms been fairly represented and explained to you?
- Does the type of loan and the loan services provided meet your need and interests?
Answering "no" to these questions could suggest the loan is possibly predatory. For more information on filing a complaint visit www.com.state.oh.us/dfi/ccmain.htm to file complaints against Depository Institutions, Non- Depository Institutions, or with the Attorney General.
For information on when a foreclosure can begin, refer to your mortgage document and promissory note. The terms of default are outlined in the contract. Each individual lending institution has their own guidelines and polices regarding when they will begin foreclosure proceedings. In Ohio, foreclosure usually begins when a complaint for is filed in a court of law."
